Terms of Service

Welcome to hearasong.ai. By using this site, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use the service.

1. About the Service

hearasong.ai is an experimental music platform. Each day, two kinds of songs are generated: a daily world song shaped by phrases contributed by listeners the day before, and personal songs created from individual users’ written reflections, voice recordings, or photos about their own day. Users can listen, react, contribute, save, favorite, and share. The service is currently free and provided on an as-is basis.

2. Eligibility

You must be at least 13 years old to use hearasong.ai. If you are between 13 and 17, you confirm that a parent or legal guardian has reviewed these Terms with you and consented to your use of the service. If you are using the service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

3. Your Account

You may sign in using Google or an emailed magic link. You are responsible for activity that occurs under your account and for keeping your access credentials secure. We may suspend or close accounts at our discretion, including for violations of these Terms.

You may request deletion of your account and associated data by emailing hello@hearasong.ai.

4. Your Contributions to World Songs

When you submit a phrase, reaction, or comment to shape a daily world song (each, a “World Contribution”), you grant hearasong.ai a worldwide, royalty-free, perpetual, irrevocable, sublicensable, non-exclusive license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display your World Contribution in connection with operating, improving, and promoting the service, including incorporating it into AI-generated world songs and related materials.

You retain ownership of your original World Contributions. You understand that once submitted, your World Contribution may be combined with the contributions of others, processed by AI systems, and displayed publicly as part of the collective world song archive, and that you cannot reverse the inclusion of a World Contribution after it has been used to generate a song.

5. Your Personal Song Content

When you submit content to generate a personal song — including written reflections, voice recordings, or photos (each, a “Personal Contribution”) — you grant hearasong.ai a limited license to process, store, and use your Personal Contribution solely to generate, store, and display your personal song to you.

Voice recordings and uploaded photos are processed and then deleted as described in our Privacy Policy.

You retain full ownership of your Personal Contributions. Personal songs are private to your account by default. We will not use your personal songs in marketing, public displays, or promotional materials without your explicit permission.

If you choose to share a personal song via a public share link, anyone with the link can view that song. You can revoke a public share link at any time.

6. Content Standards

You represent and warrant that your Contributions:

• — Are your original work or content you have the right to share
• — Do not infringe any third party's rights
• — Do not contain illegal, hateful, harassing, defamatory, sexually explicit, or otherwise harmful content
• — Do not depict or sexualize minors
• — Comply with applicable laws

We use automated moderation tools and reserve the right, but have no obligation, to review, refuse, or remove any Contribution at any time and for any reason.

7. AI-Generated Songs and Ownership

Songs on hearasong.ai are produced by AI systems using third-party music generation services. The legal status of AI-generated content is unsettled and continues to evolve, and the rights granted to hearasong.ai by our service providers may limit what we can offer to users.

For world songs: The daily world song and related generated outputs are owned and operated by hearasong.ai as part of the hearasong collective archive. You may listen, favorite, share via the features we provide, and discuss the songs. You may not independently download, redistribute, remix, modify, or commercially exploit world songs.

For personal songs: You retain ownership rights in the text, voice, and image content you contribute (your Personal Contribution). The resulting audio recording is subject to the rights granted to hearasong.ai by our underlying music generation provider, which currently limits use to personal, non-commercial purposes.

You may listen, favorite, share via the features we provide, and use your personal songs for personal, non-commercial purposes (for example: playing at a family event, sharing privately with friends, or posting to your personal social media). Commercial use (such as in advertisements, paid productions, or for sale) is not currently permitted.

We are working to expand commercial use rights for our users as licensing arrangements evolve.

We make no guarantee about the originality, accuracy, quality, copyrightability, or fitness of any generated song for any particular purpose. You use AI-generated content at your own risk.

8. Acceptable Use

You agree not to:

• — Use the service for any unlawful purpose
• — Submit harmful, abusive, deceptive, or misleading content
• — Attempt to disrupt, hack, scrape, reverse engineer, or interfere with the service or its underlying infrastructure
• — Impersonate any person or misrepresent your identity
• — Use bots, scripts, or automated tools to inflate metrics, contributions, or reactions
• — Circumvent rate limits, moderation systems, or other technical measures
• — Collect or harvest information about other users
• — Upload photos of children under 13, or content that sexualizes any minor

9. Not Medical, Mental Health, or Professional Advice

Personal songs and world songs may reflect emotional themes, but hearasong.ai is not a substitute for medical, mental health, legal, financial, or other professional advice. If you are experiencing a crisis or need professional support, please contact a qualified professional or, in the United States, the 988 Suicide & Crisis Lifeline.

10. Intellectual Property

The hearasong.ai name, logo, design, interface, code, and other materials are owned by the operators of the service and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the service without prior written permission.

11. Copyright Concerns

If you believe content on hearasong.ai infringes your copyright or other intellectual property rights, please contact hello@hearasong.ai with sufficient detail about the allegedly infringing material and your claim. We reserve the right to remove content alleged to infringe intellectual property rights at our discretion.

12. Third-Party Services

hearasong.ai relies on third-party services including Anthropic (Claude), Suno via EvoLink, OpenAI, Supabase, Vercel, Resend, and Google. Your use of the service may also be subject to the terms and privacy policies of these providers. We are not responsible for the availability, outputs, or content of third-party services.

13. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

We do not warrant that the service will be error-free, secure, or continuously available, or that any generated song will meet your expectations.

14. Limitation of Liability

To the maximum extent permitted by law, hearasong.ai and its operators, affiliates, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the service.

Our aggregate liability for any claim arising out of or related to the service is limited to one hundred US dollars (US$100) or the amount you have paid us in the past twelve months, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless hearasong.ai, its operators, affiliates, and contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the service, your Contributions, or your violation of these Terms.

16. Termination

We may suspend or terminate your access to the service at any time, with or without notice, for any reason.

You may stop using the service at any time.

Provisions that by their nature should survive termination, including ownership, license grants, disclaimers, limitations of liability, and dispute-related provisions, will survive termination.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date.

Your continued use of the service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, please stop using the service.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles.

Any disputes arising out of or related to these Terms or the service will be resolved in the state or federal courts located in the State of New Jersey, and you consent to the jurisdiction of those courts.
